Photo & Media Release Policy

Effective Date: February 13, 2026

1. Purpose and Scope

This Photo & Media Release Policy ("Policy") applies to all individuals who register for, attend, or participate in any cooking class, workshop, demonstration, event, or activity (collectively, "Classes") hosted by Rudy's at our facilities or sponsored locations.

By registering for or attending a Class, you acknowledge that Classes may be photographed, filmed, audio recorded, or otherwise documented for business, promotional, and educational purposes.

2. Grant of Rights

By participating in a Class, you grant the Company a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, distribute, publicly display, and create derivative works from photographs, video recordings, audio recordings, and any other media that captures your name, image, likeness, voice, statements, or participation (collectively, "Media Content").

Permitted Uses Include:

  • Marketing and promotional materials (print and digital)
  • Social media content (Facebook, Instagram, TikTok, YouTube, etc.)
  • Website content and blog posts
  • Email newsletters and advertising campaigns
  • Educational and instructional materials
  • Press releases and media kits
  • Internal training and documentation

3. Ownership and Control

All Media Content captured by the Company or its authorized representatives remains the sole property of the Company. You waive any right to:

  • Inspect or approve the finished Media Content before publication
  • Receive compensation, royalties, or other payment for use of Media Content
  • Revoke this license once Media Content has been created, except as provided in Section 7 below

4. No Compensation

You acknowledge and agree that you will receive no financial compensation, payment, or other consideration for the Company's use of Media Content under this Policy.

5. Participant Warranties

By granting this license, you represent and warrant that:

  • You are at least 18 years of age, or your parent/legal guardian has provided consent on your behalf
  • You have the legal right and authority to grant this license
  • The use of Media Content as described will not violate any third-party rights
  • You have not granted exclusive rights to your image or likeness to any other party that would conflict with this release

6. Minors (Under 18)

If a participant is under 18 years of age, a parent or legal guardian must provide consent on the minor's behalf by completing registration.

By registering a minor, you certify that:

  • You are the minor's parent or legal guardian
  • You have legal authority to grant this release on the minor's behalf
  • You have reviewed this Policy with the minor (if age-appropriate)

7. Opt-Out Procedure

We respect your privacy. If you prefer not to appear in photographs or recordings, you may opt out by:

Before the Class:

  • Emailing us at [email address] at least 24 hours before your scheduled Class, OR
  • Notifying staff at check-in before the Class begins

Important Limitations:

  • We will make reasonable efforts to exclude you from Media Content when you opt out
  • We cannot guarantee complete exclusion from group shots, background footage, or incidental inclusion in classroom settings
  • Opt-out requests apply only to intentional featured photography/videography
  • You may still appear in wide-angle or background shots during group Classes

8. Release of Liability

To the fullest extent permitted under Idaho law, you release, discharge, and hold harmless the Company, its owners, officers, employees, agents, contractors, and representatives from any and all claims, demands, causes of action, damages, or liability arising from or related to:

  • The capture, use, reproduction, or distribution of Media Content
  • Claims of invasion of privacy, violation of right of publicity, defamation, or infliction of emotional distress
  • Any editing, alteration, or use of Media Content in any context

This release does not extend to claims arising from the Company's gross negligence, willful misconduct, or violation of applicable law.

9. Severability

If any provision of this Policy is found to be invalid or unenforceable under Idaho law, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

10. Modification of Policy

We reserve the right to modify this Policy at any time. Changes will be effective immediately upon posting to our website or upon notice to registered participants. Your continued participation in Classes after changes are posted constitutes acceptance of the modified Policy.

11. Governing Law and Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to conflicts of law principles. Any disputes arising from this Policy shall be resolved in the state or federal courts located in [Your County], Idaho.

12. Acknowledgment and Acceptance

By completing registration, making a purchase, or attending a Class, you acknowledge that:

  • You have read and understood this Photo & Media Release Policy
  • You have had the opportunity to ask questions about this Policy
  • You voluntarily agree to the terms set forth herein
  • If registering for a minor, you have the legal authority to provide consent on their behalf
